The Age Discrimination in Employment Act (“ADEA”) is a federal law that protects workers and job applicants aged 40 and over from age-based discrimination in all aspects of employment. State and local laws provide similar protections.
These laws prohibit discrimination in the workplace on account of an individual’s age, including hiring, firing, pay, job assignments, promotions, layoff, training, benefits, and any other term or condition of employment.
Even though age discrimination is illegal, many employers still violate these laws by encouraging older workers to retire, excluding older workers from team building exercises and training, or by disciplining older workers in a manner that their younger colleagues are not treated.
